Photography
Agreement
This Agreement is between byLera Photography (the “Photographer”) and the person arranging a session (the “Client”). Requesting a date does not itself hold a booking. A session is confirmed only after I confirm the details and the $100 retainer is paid. Please read these policies before sending your request.
The experience
We will agree on a package, location, date and start time before your session is confirmed. I will photograph the session, select the strongest images, and deliver a professionally edited digital collection. The edited photos will normally be ready within three days of the shoot. If an unexpected technical or scheduling issue affects delivery, I will let you know as soon as possible.
Retainer and payment
A $100 non-refundable booking retainer is required to secure a confirmed session. The $100 is credited toward the total package price, not charged in addition. The remaining balance is due no later than the day of your shoot. Finished photographs are delivered after payment is complete. If you cancel, the retainer is non-refundable, except where a refund is required by law or specifically agreed in writing. Once services are performed, payments are non-refundable except as required by law.
What your package includes
Package One is 30 minutes at one location with 15 finished photographs. Package Two is 60 minutes at two locations or a studio with 30 finished photographs. Package Three is 120 minutes at two or three locations with 60 finished photographs and a short video reel. Your price depends on whether you selected Women’s Portrait, Maternity, Love Story or Family; the total is displayed before you request the session. I choose and edit the final images at my professional discretion.
RAW and unedited files
Only the finished, edited photographs are supplied. Original camera files, RAW images and unedited selections are not included or available for delivery.
How long your gallery stays online
Your digital gallery will be available for approximately six months after delivery. Please download and back up your files during that window. The online gallery and stored files may be removed afterward.
Cancelling your session
Please let me know at least 48 hours before the booked start time if you need to cancel. The $100 booking retainer is non-refundable in cancellation cases, subject to applicable law. Late cancellations and missed appointments do not automatically entitle you to a refund.
Moving to a different date
If you need to reschedule, contact me at least 24 hours before the session. Subject to an available new date, the retainer will move with your booking rather than being charged again. If severe weather or another unforeseen condition prevents a safe or practical outdoor shoot, we will arrange a mutually available replacement date at no extra rescheduling cost, and your retainer will transfer.
Kind communication and cooperation
Please communicate respectfully during planning, in person and in follow-up messages. Threats, harassment or seriously inappropriate conduct may require me to stop a session or decline future services. Financial consequences will be handled under the applicable law and the circumstances. A relaxed and cooperative atmosphere helps create the best photographs.
Sessions with children
Parents and guardians remain responsible for supervising their children and keeping them safe. I will be patient with shy or upset children, but I cannot guarantee a particular expression, mood, pose or level of cooperation. Ordinary challenges with a child’s mood are not, by themselves, grounds for complimentary reshoots or refunds.
Outdoor locations and conditions
Outdoor photography can mean unpredictable temperatures, insects, uneven paths, wind and shifting light. Please plan appropriate footwear, clothing and personal precautions. I cannot control normal outdoor conditions or reactions beyond my reasonable control; this does not exclude liability where it cannot legally be excluded.
A shared creative vision
Before the shoot, we can talk about mood, ideas and outfits so the experience reflects you. I photograph and edit in the natural, candid style shown throughout my portfolio. Lighting, posing, framing and color are part of my artistic judgment, and exact recreations of reference photographs are not guaranteed.
Retouching and final edits
Editing is natural and true to my aesthetic. Small body adjustments or subtle touch-ups may be considered on request, depending on the image, but extensive retouching, alternate treatments and extra rounds of edits are not included unless we agree to them separately. The final selection is made by me, and I do not provide RAW files.
Privacy and sharing
I may wish to feature selected photos on my website, in my portfolio or on social media. You may request a private session before the shoot, including by selecting “Keep my session private” in the booking request, and I will honor that request. I will seek appropriate parent or guardian permission before publicly sharing recognizable photographs of children. Let me know about any other privacy or sharing restrictions during planning.
Punctuality
Please arrive ready at the arranged start time. Arriving late usually reduces the time available to photograph you, rather than extending the booked session. Time lost to a late arrival or a missed shoot is not refundable.
Safety and responsibility
Please look after your belongings and take reasonable care at our shooting location. Each party remains responsible for losses caused by its own negligence or misconduct. I am not responsible for circumstances outside my reasonable control to the extent permitted by law. Nothing here removes a legal protection that cannot be waived.
Right to decline services
I may refuse a new booking or end a session when conduct is abusive, unsafe or seriously disrespectful. Any amount due or refundable will be decided consistently with applicable law.
Working through a concern
If something goes wrong, please reach out so we can try to solve it by talking first. We can consider voluntary mediation if a direct conversation does not resolve the issue, without limiting either side’s legal rights.
Submitting a booking request means you have reviewed these terms. Payment of the retainer after confirmation signifies acceptance, subject to applicable law. You can download or save a copy for your records.
